RE: The tariff classification of printed plastic cards, bookmarks, key rings, printed paper greeting cards, and note pads, from Venezuela.

Dear Mr. Martinez:

In your letter dated November 9, 1993, you requested a tariff classification ruling. Five samples were submitted and will be retained for reference.

Item (1) is a 2 1/8" x 3 3/8" sheet of semi-flexible plastic which has been printed, on each side, with wording accompanied by a colorful picture or design. Although the sample has the dimensions of a credit card and bears a romantic, keepsake-type message (in Spanish), you indicate that the article will be offered in various sizes and with messages for all occasions.

The applicable subheading for the printed plastic card will be 4911.99.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other (non-enumerated) printed matter. The rate of duty will be 4.9%.

Item (2) is a tongued bookmark made of flexible plastic sheeting. It measures about 1 1/2" x 7" and is printed with captioned cartoon figures. The printing appears to be incidental to the item's use as a bookmark.

The applicable subheading for the bookmark will be 3926.90.9590, HTS, which provides for other (non-enumerated) articles of plastics. The rate of duty will be 5.3%.

Item (3) is a key ring consisting of a steel wire O-ring with chain, attached to which is a decorative, miniature deck of four plastic cards printed with cartoons.

The applicable subheading for the key ring will be 7326.20.0050, HTS, which provides for other (non-enumerated) articles of iron or steel wire. The rate of duty will be 5.7%.

Item (4) is a large (8" x 11") folded paper greeting card, printed with designs and a personal message. It is packed, together with a matching envelope, in a transparent plastic sleeve.

The applicable subheading for the greeting card will be 4909.00.4020, HTS, which provides for printed greeting cards, with or without envelopes or trimmings. The rate of duty will be 4.9%.

Item (5) is a small note pad consisting of numerous 2 3/4" x 4 1/4" sheets of pastel-colored paper bearing muted pictorial images. The sheets are adhesive-bound along their top edge and have a wrap-around, printed paper cover.

The applicable subheading for the note pad will be 4820.10.2020, HTS, which provides for memorandum pads, letter pads and similar articles, of paper or paperboard. The rate of duty will be 4%.

Articles classifiable under any of the above HTS subheadings, which are products of Venezuela, are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
