RE: The tariff classification of certain perforated, uncoated, paper, from Japan.

Dear Ms. Kajer:

In your letter dated November 11, 1993, you requested a tariff classification ruling.

The paper of this inquiry is described as "opaque..used on the Cal Comp Colormaster Model 6613 printer." It is perforated, to provide for a "tear off strip" along one edge, and is imported in rectangular sheets of various sizes. Each size is designated with a "part number". (Two "Part numbers" are not perforated, but are presumed to be of the same description, otherwise).

Samples were submitted, and have been analyzed by the Customs Laboratory, which finds that they are "uncoated white paper, weighing 96.2 grams per square meter, having a burst strength of 192.9 KPA and a thickness of 0.090 mm. They are made of bleached kraft pulp fibers, but do not meet the tariff specifications for "Sackraft" or "Kraftliner".

The two "part numbers" which are not perforated, 16128-0086, imported in rectangular sheets measuring 11.69"x20", and 19926- 0035, imported in sheets of the same size, are classifiable in HTS subheading 4802.52.9000, which provides for: Other (than certain enumerated) paper of a kind used for writing, printing or other graphic purposes, meeting certain physical specifications and imported in rectangular sheets of specified sizes. The rate of duty is Free.

"Part Numbers" 16128-0052, perforated, imported in rectanular sheets measuring 11"x10.25", and 16128-0060, perforated, imported in rectangular sheets measuring 11.69"x10", are classifiable in HTS subheading 4823.51.0080, which provides for: Other (than certain enumerated) paper, cut to size or shape, of a kind used for writing, printing or other graphic purposes, printed, embossed or perforated. The rate of duty is 3 percent.

The remaining "part numbers"; 16128-0037, 16128-0045, 19926- 0027 and 19953-0031, all perforated papers of the kind described by the laboratory analysis, imported in rectangular sheets, of which the smallest length is 18.29" and the longest length is 18.75", are classified in HTS subheading 4808.90.6000, which provides for: Paper, perforated, in rolls or sheets of specified sizes, other than corrugated, creped, crinkled, or embossed. The rate of duty is 5.3 percent.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
