RE: The tariff classification of a handbag and a hat from China.

Dear Mr. Murray:

In your letter dated July 1, 1993, received in this office August 5, 1993, on behalf of Sand Bags Too, Inc., you requested a tariff classification ruling for a handbag and a hat.

You have submitted two samples with your request, identified as samples 1 and 2. They are as follows:

Sample #1, identified as a "Handbag of Paper Straw", is a crocheted handbag composed of woven paper yarn. It is unlined and measures approximately 9 1/2" x 9" with an oval base. The handbag is secured by means of a top drawstring rope-like closure.

Sample #2 is a lady's hat made of woven paper yarn with a 2 1/2 inch brim and a flower on the side made of the same material.

The applicable subheading for Sample #1, the lady's handbag of paper yarn, will be 4202.22.8060, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, other, other. The duty rate will be 20 percent ad valorem.

Items classifiable under 4202.22.8060 fall within textile category designation 871. Based upon international textile trade agreements, products of China are subject to visa requirements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

The applicable subheading for Sample #2, the lady's hat of woven paper yarn, will be 6504.00.6000, HTS, which provides for Hats and other headgear, plaited or made by assembling strips of any material, whether or not lined or trimmed: Of vegetable fibers, of unspun fibrous vegetable materials, of paper yarn or of any combination thereof: Not sewed. The duty rate will be $l.02/doz. plus 5 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
