RE: The tariff classification of Captopril (CAS# 62571-86-2), Cyclobenzaprine (CAS# 6202-23-9), Clozapine (CAS# 5786-21-0), Diclofenac Sodium (CAS# 15307-79-6), and Enalapril (CAS# 76095-16-4), all imported in bulk form, from Spain

Dear Mr. Staub:

In your letter dated May 7, 1993, received June 29, 1993, on behalf of Medichem Tradex S.A., you requested a tariff classification ruling.

Captopril is an anti-hypertensive drug;
Cyclobenzaprine is a muscle-relaxant drug; Clozapine is an anti-psychotic drug; Diclofenac Sodium is an anti-inflammatory drug; and Enalapril is an anti- hypertensive drug.

The applicable subheading for Captopril will be 2933.90.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for heterocyclic compounds with nitrogen hetero-atom(s) only; nucleic acids and their salts: other: other: other: drugs. The rate of duty will be 3.7 percent ad valorem.

The applicable subheading for Cyclobenzaprine will be 2921.49.4000, HTS, which provides for aromatic monoamines and their derivatives; salts thereof: other: other: drugs: other. The rate of duty will be 8.2 percent ad valorem.

The applicable subheading for Clozapine will be 2933.90.5700, HTS, which provides for heterocyclic compounds with nitrogen hetero-atom(s) only; nucleic acids and their salts: other: aromatic or modified aromatic: other: drugs: drugs primarily affecting the central nervous system: antidepressants, tranquilizers and other psychotherapeutic agents: Clozapine; and Droperidol. The rate of duty will be 6.6 percent ad valorem.

The applicable subheading for Diclofenac Sodium will be 2922.49.2500, HTS, which provides for amine- acids and their esters, other than those containing more than one kind of oxygen function; salts thereof: other: aromatic: other: drugs. The rate of duty will be 7 percent ad valorem.

The applicable subheading for Enalapril will be 2933.90.5300, HTS, which provides for heterocyclic compounds with nitrogen hetero-atom(s) only; nucleic acids and their salts: other: aromatic or modified aromatic: other: drugs: cardiovascular drugs: other. The rate of duty will be 8 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
