RE: The tariff classification of ladies' wearing apparel from Hong Kong

Dear Mr. Bodek:

In your letter dated April 2, 1993, you requested a tariff classification ruling on behalf of Ellen Tracy, Inc.

Style 71482 ia a 100 percent woven silk blouse. The garment is sleeveless and features a full opening in the back secured by six plastic buttons. Overlaid on the garment are five vertical lace strips (three on the front, two on the back). The strips measure approximately three inches in width. These overlays are composed of 57 percent nylon/43 percent polyester. You indicate that the lace material was produced on a Leavers nine point machine. The blouse has a hemmed bottom and extends to the hip area.

Style 1483 is a camisole constructed of an outer lace shell composed of 57 percent nylon/43 percent polyester, with a 100 percent woven silk lining. This lace material was also produced on a Leavers nine point machine. The garment features spaghetti straps made from the silk fabric. The lace outer shell and the silk lining each have a hemmed bottom. The garment extends to the hip area.

Your samples will be returned as you have requested.

The applicable subheading for the style 71482 will be 6206.10.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' blouses, shirt- blouses: Of silk or silk waste... other: containing 70 percent or more of silk or silk waste. The rate of duty will be 7.5 percent ad valorem.

The applicable subheading for style 1483 will be 6211.43.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women's or girls': Of man made fibers...other. The rate of duty will be 17 percent ad valorem. Style 1483 falls within textile category designation 659. As a 100 percent silk product, style 71482 does not fall within a textile category. Based upon international textile trade agreements, style 1483, which is a product of Hong Kong, is subject to a visa requirement. Products of Honk Kong are currently not subject to quota restraints.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
