RE: The tariff classification of a woman's woven vest and knitted top from China, Hong Kong or Thailand

Dear Ms. Denny:

In your letter dated September 23, 1994, you requested a classification ruling.

Style ZIP DENIM is a vest constructed from 100 percent cotton woven denim. The vest features a full front opening with a zipper closure, a collar and two chest flaps. The garment reaches the waist.

Style J-ZIP is a garment similar to a cardigan. The garment is constructed from knit fabric that is 65 percent polyester/35 percent cotton. The garment features a drawstring hood, short sleeves and a zippered full front opening. The outer surface of the garment has more than nine stitches per two centimeters in the horizontal direction. The garment reaches the waist.

As you have requested, your samples will be returned to you.

The applicable subheading for ZIP DENIM will be 6211.42.0070, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women's or girls': of cotton: vests. The rate of duty will be 8.6 percent ad valorem.

The applicable subheading for J-ZIP will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: women's or girls'. The duty rate will be 34.2 percent ad valorem.

Style ZIP DENIM falls within textile category designation 359 and style J-ZIP falls within textile category 639. Based upon international textile trade agreements products of China, Hong Kong and Thailand are subject to a visa requirement. Products of China and Thailand are subject to quota restrictions.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
