RE: The tariff classification of luggage carts from Taiwan

Dear Ms. Lam:

In your letter dated April 28, 1993 you requested a tariff classification ruling. You have submitted samples of the imported products which are five styles of luggage carts, as follows:

ITEM NO DESCRIPTION

501W Folding luggage cart, with a chrome frame, two plastic wheels, and a bungie cord with end hooks

67144 Folding luggage cart, with a chrome frame, two plastic wheels, and a bungie cord with end hooks

801P Folding luggage cart, with a chrome frame, two plastic wheels, and a bungie cord with end hooks

802 Folding luggage cart, with an aluminum telescopic frame, caster front wheels, EVA foam rear wheels, and a bungie cord with end hooks

900 Folding luggage cart, with an aluminum and plastic frame, two plastic wheels, and a strap

The applicable subheading for the folding luggage carts will be 8716.80.5090, Harmonized Tariff Schedule of the United States (HTS), which provides for other vehicles, not mechanically propelled. The rate of duty will be 3.2 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
