RE: The tariff classification of a travel bag from China.

Dear Mr. Weaver:

In your letter dated April 22, 1993, on behalf of Pentasource, Inc., you requested a tariff classification ruling on a travel bag.

The sample submitted, article #500-0588, is a travel bag constructed of clear plastic designed to contain bath and beauty products. The bag is cylindrical in shape, flat on the top and bottom, and has a textile zipper closure around the entire top circumference. There is a textile ribbon-type carry handle attached to the top panel. The bag is approximately 18cm tall and 11.5cm in diameter.

The applicable subheading for article #500-0588, the travel bag of clear plastic, will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of plastic sheeting, other. The duty rate will be 20 percent ad valorem.

Your reference to the country of origin marking noted. Section 304 of the Tariff Act of 1930 as amended requires that the article be marked with the English name of the country of origin in as permanent, legible, and conspicuous manner as the article will permit. We recommend that each case be marked by means of a sewn-in fabric label which reads "Bag Made in China" into the top inside seam.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
