RE: The tariff classification of a travel cosmetic bag from China.

Dear Mr. Langtry:

In your letter dated April 6, 1993, on behalf of Auto-Shade, you requested a tariff classification ruling on a travel cosmetic bag.

The submitted sample, no style number indicated, described as a "Cosmetic Organizer", is a PVC travel cosmetic bag designed with elastic straps on the rear exterior. Although it is designed for use in a motor vehicle, it also is a travel bag for personal effects during travel. Its use as a travel bag appears to be the principal use. The interior is designed with several compartments to hold lipstick, mascara, make-up brushes, etc.. A small detachable mirror fastens to the bottom portion by means of a hook and loop fastener. The bag measures approximately 7 1/2" x 5". It is secured by means of a textile zipper closure, in addition to a flap with a hook and loop fastener.

The applicable subheading for the travel cosmetic bag of PVC, will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of plastic sheeting, other. The duty rate will be 20 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
