RE: The tariff classification of shift controls from Mexico

Dear Mr. Freeman:

In your letter dated January 16, 1990, on behalf of Felsted Cables, Controls and Control Systems, Holmesville, Ohio, you requested a tariff classification ruling. You have enclosed descriptive literature and photographs of the imported merchandise.

You have submitted four items:

Product no. 1 is a shift control for Allison automatic transmissions (part no. 55051-2760) which is a basic design with no options. The shift control is used to change gears on automatic transmissions. This item is principally used in trucks and buses.

Product no. 2 is a shift control for Allison automatic transmissions (part no. 55755-2363) with optional reverse and neutral switches and a push button knob. This item is principally used in military vehicles.

Product no. 3 is a shift inhibitor transmission control for Allison transmission (part no. 56052-2409) with optional air cylinder for multi-function interlock. This locks or holds the control in neutral range when the air system is energized. It is designed to prevent high RPM shifts. This item is principally used in garbage trucks.

Product no. 4 is a Vernier control cable head with a ball screw rotary-to-linear mechanism, used for manual throttle control, setting engine RPM or other applications requiring adjustments. Cables are included. This item is principally used in trucks and buses.

The applicable subheading for the above listed shift controls, shift inhibitor transmission control, and Vernier control cable head will be 8708.99.5090, Harmonized Tariff Schedule of the United States (HTS), which provides for other parts and accessories of motor vehicles. The rate of duty will be 3.1 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
