RE: The tariff classification of lady's handbags from Hong Kong.

Dear Mr. Pontieri:

In your letter dated September 11, 1990, on behalf of NAS Import Corp., you requested a tariff classification ruling.

You have submitted three samples of lady's handbags with your request. Style numbers 8250C, 8407C, and 7294AW, all of which are constructed of man-made fibers with imitation reptile leather trim.

Style # 8250C is a shoulder bag measuring approximately 14" x 12", with top double zippered compartments, with an inside zippered pocket. The front panel is constructed essentially of man-made tapestry fabrics with imitation reptile leather panels. The back panel is constructed of imitation reptile leather, with an adjustable shoulder strap.

Style #8407C is a shoulder bag measuring 14" x 11", with an inside zippered pocket and a textile lining. The front of the bag is constructed of man-made tapestry fibers with imitation reptile leather panels. The back is composed of man-made fibers and features a full width zippered pocket. The bag is closed by means of a magnetic snap closure. There is an attached tassel of imitation reptile leather at the end of the snap closure.

Style #7294AW is a shoulder bag measuring approximately 9 1/2" x 9 1/2", with double inside compartments, two zippered pockets, and a textile lining. The front panel is composed of man-made tapestry fabrics with imitation reptile leather panels. The back panel is composed of imitation reptile leather. It has an adjustable shoulder strap of imitation leather, and is closed by means of a magnetic snap closure. There is an attached tassel of imitation leather at the end of the snap closure. Your samples are being returned per your request.

The submitted samples, style numbers 8250C, 8407C, and 7294AW, was said to be constructed of "Jute", a vegetable fiber. Laboratory analysis have proven the bags to be constructed of man-made fibers, showing no "Jute" in the component breakdown.

The applicable subheading for style numbers 8250C, 8407C, and 7294AW, the shoulder bags of textile man-made fibers, will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, of textile materials, other, other, other, of man-made fibers. The duty rate will be 20 percent ad valorem.

Item 4202.22.8050 falls within textile category designation 670. Based upon international textile trade agreements, products of Hong Kong are subject to visa requirements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
