RE: The tariff classification of a woman's knit garment from Great Britain.

Dear Mr. Ficarelle:

In your letter dated July 25, 1990, on behalf of Mr. Josh Cohen, you requested a tariff classification ruling.

The submitted sample is a woman's knit garment called a "Bodyline 12 in 1 Stretch Fashion Collection". The garment will be constructed of 90% cotton/10% lycra, or 47% polyester/47% cotton, 6% lycra, or 51% polyester 49% cotton. The garment is a tube, open at both ends and in its unstretched state it measures 24 inches in length and 12 inches in width. There are two slits in the mid upper portion of either side of the garment. Each slit contains 2 sets of 4 metal reinforced holes and a detachable shoe string. The garment is sold in a plastic bag, which has an advertisement on the back demonstrating how it can be worn. The various uses for this article are as follows: stretch dress, bandeau, off one shoulder top, off two shoulders top, skirt, mini skirt, bra-top, bikini top, tube top, cowl snood and collar top pullover.

The applicable subheading for the Bodyline 12 in 1 Stretch Fashion Collection if in chief weight of cotton will be 6114.20.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knit, for women of cotton, other. The rate of duty will be 11.5 percent ad valorem.

The applicable subheading for the Bodyline 12 in 1 Stretch Fashion Collection if in chief weight of man-made fibers will be 6114.30.3070, HTS, which provides for other garments, knit, for women of man-made fibers, other. The rate of duty will be 16.1 percent ad valorem.
The Bodyline 12 in 1 Stretch Fashion Collection, if in chief weight of cotton, falls within textile category designation 359. Based upon international textile trade agreements, products of Great Britain have no visa or quota requirements.

The Bodyline 12 in 1 Stretch Fashion Collection, if in chief weight of man-made fibers, falls within textile category designation 659. Based upon international textile trade agreements, products of Great Britain have no visa or quota requirements.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
