RE: The tariff classification of knitting crafts and basket weaving sets from China

Dear Ms. Gasser:

In your letter dated July 11, 1990, you requested a tariff classification ruling.

The samples submitted are referred to as the "Rainy Day Craft Assortment", Item #40124PDC, which includes 3 different craft sets. All of the sets are designed to introduce children to the basics of knitting and weaving.

The first kit allows the child to choose from 3 different knitting crafts and contains the following: a weaving loom, a square loom, a spool loom, crochet hook, one pair of knitting needles, a weaving shuttle, a plastic needle and assorted color yarns.

The second article is a basket weaving set which includes: two large round baskets, two small round baskets, two large oval baskets, two small oval baskets, four bundles of thick weaving threads, three bundles of thin weaving threads and decorative stick on designs.

The last item is a knitting loom which includes four bundles of yarn, two pom pom knitters and five assorted plastic needles. All of the looms and accessories are made of plastic and have a very limited functional use.

The applicable subheading for the craft sets will be 9503.70.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys, put up in sets or outfits, and parts and accessories thereof: other: other. The duty rate will be 6.8 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.

Sincerely,

Jean F. Maguire
Area Director
