My wife came to US on J2.When i changed to H1 her employer(she is a nurse)applied for a H1B, and INS rejected it.Meanwhile employer lawyer had also filed 1-140 and INS granted my wife 1-140. Meanwhile when i changed to H1 my employer submitted a H4 petiton for my wife which got apporved after she got her 1-140 approved.It took us 5 months to assemble all the papers for the 1-485 application filing.She had work authorization under J2 untill her I-140 got approved.Since we thought i-140 is a permit to work my wife did work during this period.
Does anybody think that this is a violation?
