Respected Sir/Madam,
  I am working at a company X now.Now my company has opened a offshore development centre outside the united states in a country C. Now, two engineers from country C are working at a company Y in US and they have work permit(H1-B) with this company Y. But, as that company is closing its shop in the US in about three months and so not caring about the employees attendance much.

Now, here is the actual problem:

These 2 engineers know the head of my company's offshore development centre and so they are recruited by him in the offshore development centre in country C.But, instead of returning their home country & work at the offshore development centre , these 2 engineers have started working at my company in the US.They did not get any visa through my company nor even a business visa on my company's behalf.They never even applied for one.And moreover, these 2 engineers are still on company Y's payroll.
Is it Legal?.
If it is illegal, under what law(and section etc..)?
Can you please let me know.
