My wife was recently ticketed in California under vc27315...

My wife was recently ticketed in California under vc27315 for wearing her seat belt improperly.  I think the motor officer didn't see that she was wearing the belt because she had the shoulder belt under her arm (the belt cuts her neck).  I've researched the vehicle code and the California Drivers Manual and cannot find where it says this is illegal.  We're inclined to fight this dumb ticket.  Anybody got any info which could help?  Thanks in advance.

I don't know whether this is illegal in California, but in some states it is, because it is extremely dangerous. In a relatively mild collision, her internal organs could be ruptured. Never wear a seat belt this way! You can buy seat belt adjusters that address exactly that problem at big auto supply stores, like Pep Boys or Kragen, or you can do what I do, and put a sweater or a towel between your neck and the seat belt.

The same thing happened to me except the officer acknowledged the seatbelt was buckled but said I was wearing it improperly.  My courtesy notice says violation vc27315d "Seatbelt not used".  Since this was not true, I am also inclined to fight it.  Anyone else have an idea?

My daughter just got the same ticket and the fee is $197.  How was the outcome of your ticket?

Is there any info you can give my that could help?

THE CASE LAW SAYS IF A SEATBELT IS DESIGNED TO BE WORN OVER THE LAP/SHOULDER, IT HAS TO BE WORN THAT WAY.
