I am a J1 visa holder and currently working as an MD. Would my application for O1 visa ( and J1 - HRR waiver) be jeopardized by my not so clean police record??

If I return my home country after the expiration of validity of J-1, is it possible for me to apply for an F-1 visa from my home country within the next 2 years (during the HRR)?
